Warranty against defects
AVR warrants that the Goods will be free from defective workmanship and materials during the Warranty Period (“Warranty”).
Please see the section of this document titled “How to make a Warranty claim” for information on how to make a claim under this Warranty and what AVR will do if Goods are defective.
Warranty is provided in addition to guarantees
The Goods come with guarantees that cannot be excluded under the Australian Consumer Law. The Purchaser is entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. The Purchaser is also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
Sole and exclusive warranty
This Warranty is the sole and exclusive warranty granted by AVR in respect of the Goods and, except for other rights and remedies of the Purchaser under the Australian Consumer Law (which are described above), will be the sole and exclusive remedy available to the Purchaser in respect of the Goods.
AVR does not authorise any employees or representatives of any reseller nor any other person to purportedly provide any additional warranties, or to purportedly extend the duration of the Warranty beyond the relevant Warranty Period on behalf of AVR.
AVR’s liability
The repair, replacement or refund of the defective Goods or Parts at AVR’s election will constitute complete fulfilment of all liabilities and responsibilities of AVR to the Purchaser under this Warranty and, subject to any guarantees, remedies and liabilities that cannot be excluded under the Australian Consumer Law, will constitute full satisfaction of all claims under the Warranty, whether based on contract, negligence, and strict liability otherwise.
AVR will not be liable to the Purchaser or in any way responsible for any incidental or consequential economic or property damage, except to the extent that AVR is in breach of the guarantees provided to the Purchaser in accordance with the Australian Consumer Law, or applicable legislation from time to time.
